conducted under rules of procedure issued by an arbitration institution.\nIt is this institution expressly designated by the Parties in the arbitration agreement of their contract which will then manage the procedure. These institutions generally have their own arbitration rules to which reference should be made for the choice of arbitrators in particular. A team of professionals is present within each arbitration institution to organize and administer the procedure.\n\nWhen arbitration is said <span class=\"text-semi-bold\">\"Ad Hoc\"<\/span> it is a procedure conducted without recourse to an administrative authority and therefore usually without the aid of rules institutional procedures. These rules may therefore be the subject of a debate during the procedure between the Parties who will then have to cooperate to appoint in particular the arbitrators who will resolve the dispute without institutional control.\n\n\nThe use of arbitration is valuable, particularly in the context of disputes that require the experience of business experts. It is also an asset concerning the procedural delays which can be more controlled.\n\n\nThe choice of one or the other form of arbitration therefore deserves careful analysis by the Parties when drafting the arbitration clause <span class=\"text-semi-bold\">(or arbitration clause)<\/span>, beyond the sole criterion of the institution's costs.<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-502d6d6 exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-heading\" data-id=\"502d6d6\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Avantages essentiels<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-daf9e10 exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"daf9e10\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix translation-block\"><span class=\"text-semi-bold\">Arbitration proceedings are not public.<\/span>\n\nThe <span class=\"semi-bold text\">arbitration proceedings <\/span> (including the hearings) are not <span class=\"semi-bold text\">accessible to the public<\/span> . The parties and the arbitrator are often <span class=\"text-semi-bold\">subject to strict rules of confidentiality<\/span>. Arbitrators can be chosen from various nationalities and professions.
